JUPA “AIM FOR THE TOP” CONTEST
Contest Rules
- The “Aim for the top” Contest
is being held across Canada and USA by Jupa Sports, a division
of Les Boxers Boyz inc. (hereafter “Contest Organizer”). The
contest will run from July 1st, 2008, to December 31st, 2008,
at 11:59 p.m. (EST) (hereafter “Duration
of the Contest”).
ELIGIBILITY
- NO PURCHASE REQUIRED This contest is open to Canadian and *US residents who have reached the age of majority in their province, state or territory of residence with the exception of employees, agents, and representatives of Jupa Sports, division of Les Boxers Boyz, as well as their affiliate companies, advertising and marketing agencies, partners, participating merchants, suppliers of prizes, materials and services related to this contest, as well as any other individuals who are directly related to the contest, as well as their immediate family members (brothers, sisters, children, mothers, fathers), their legal and common-law spouses, and all those residing with these employees, representatives and agents. *VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
HOW TO ENTER
- Go to a Jupa products participating merchant and try on one of their Jupa outdoor jackets to receive, from the merchant sales representative, a contest entry form. You can participate by filling out the contest entry form and dropping your entry form off at a designated contest entry box OR by logging on to www.jupasports.com website. Prizes: one (1) snowboard in each participating merchant, plus five (5) snowboards for those participating online. Each snowboard is valued at approximately $250.
ENTRY
- There are two (2) ways to enter the contest, namely:
- Online
No purchase required. Log on to the www.jupasports.com website and click on “Aim for the top contest” in order to enter.
- Once you have accessed the online contest entry form, fill it out and ensure that you enter your exact information and complete all required fields, including the correct answer to the math skill-testing question included therein. Click on the “Submit” icon to submit your online entry form no later than by midnight on December 31st, 2008. Once you have received notification confirming the receipt of your entry form, you will then be automatically entered in the contest.
- Increase your chances of winning! Once you have completed your entry form, follow the instructions therein to refer the contest to someone you know. To refer the “Aim for the top” Contest to someone you know, you will need to enter their name and email address in the appropriate field, and that person will automatically receive an email message inviting him/her to enter the contest. For each individual and valid email address that you refer the contest to, you will get one (1) additional chance of winning the contest, for a maximum of three (3) additional chances per person, one for each person you refer, for the duration of the contest. Each of your three potential additional contest entries will be automatically generated by the system.
- Contest participants must respect the restrictions which appear below. Contest organizers reserve the right to void a participant’s entry or entries if he/she does not conform to the following:
- Limit of four (4) entries per person for the duration of the contest;
- Single contest entry per person, and use of a single and same email address per person in case he/she has more than one email address.
- By visiting participating Jupa product merchants.
To enter, visit a Jupa products participating merchant, try on one of their Jupa outdoor jackets, completely fill out the entry form available in a participating Jupa product merchant, and ensure that you provide your details, including: first and last name, complete address, city, postal code, telephone numbers (including area code), age as well as email address.
Participants must drop their entry form off at the designated contest entry box in any Jupa product participating merchant in Canada and US, between July 1st, 2008 and *5 pm. on December 31st, 2008 (Local Time). *As per the closing hours of participating stores.
- The following conditions apply for the duration of the contest:
- Limit of one (1) entry form per person per day, for the duration of the contest;
- Faxed copies or hand and machine copies of entry forms will be automatically rejected.
PRIZE
- The prize entails:
One (1) snowboard, with Jupa graphics, model: MS-145, manufactured by NINGBO MAOSEN SPORT GOODS CO., LTD, No.2 Jixia Road Xiapu Industry Area Beilun Ningbo ZJ 315807 CHINA.
The prize is valued at $ 250. Bindings not included.
Prize may not be exchanged, transferred, reimbursed or exchanged for cash.
DRAW
- At 10 am. ET, on January 30th, 2009, at the headquarters of Jupa Sports, division of Les Boxers Boyz inc., at 9600, Meilleur, Suite 610, Montreal Qc Canada H2N 2E3, a random draw will be made to determine one (1) winner per participating merchant. There will be one (1) draw held per participating merchant using all the contest entries submitted at that merchant. If the entry form drawn does not conform to all the conditions described in these Contest Rules, that participant’s entry form will be voided and a new draw will take place according to these Contest Rules until a drawn entry form is declared a winner.
The online entry form draw will be held at 10 am. ET, on January 30th, 2009 in the offices of Jupa Sports, division of Les Boxers Boyz inc., at 9600, Meilleur, Suite 610, Montreal Qc Canada H2N 2E3. If the entry form drawn does not conform to all the conditions described in these Contest Rules, that participant’s entry form will be voided and a new draw will be held according to these Contest Rules until a drawn entry form is declared a winner.
- The chance that an entry form that was submitted in-store or online is randomly selected, depends on the total number of entries received from the beginning of the contest and on whether the entry will be drawn from among in-store or online entries, as per paragraph 4.
CLAIMING YOUR PRIZE
- In order to be declared winner, the drawn participant must:
- Have provided the correct answer to the math skill-testing question as requested by the Contest Organizer;
- Be contacted by Contest Organizers within 7 days of the draw;
- Sign the Declaration and Release Form (hereafter “Declaration Form”), which will be mailed to him/her, and return it to the Contest Organizer within 15 days following its reception.
- Failure to respect any of the conditions described in the above paragraph or any other condition described in these Contest Rules will result in the voidance of the drawn participant’s entry, and a new draw for this prize will be held according to these Contest Rules until a drawn participant is declared winner.
- The prize will be handed out in-stores of participating merchant within two (2) weeks of the reception of the completed and signed Declaration Form.
GENERAL CONDITIONS
- Verification. The entries are subject to verification by Contest Organizers. Any entry that is incomplete, illegible, fraudulent will be automatically rejected and will not be eligible for the prize draw.
- Non-compliance. Contest organizers reserve the right to disqualify any individual or void one or several entries of any contest participant, or individual wishing to participate in the contest in a way that is non-compliant with these Contest Rules. This person may face legal charges.
- Acceptance of Prize. All prizes must be accepted as they have been described in these Contest Rules and cannot be transferred to another party, substituted by a different prize, partially or completely cashed in, subject to the subsection which appears below.
- Prize Substitution. If, for reasons unrelated to the winning party, Contest Organizers are not able to award the prize (or a part thereof) as described in these Contest Rules, they agree to award a prize (or part thereof) of the same nature and equal value, or at their discretion, the equivalent in value of the prize (or part thereof) described in these Contest Rules in cash.
- Refusal to Accept Prize. Should the participant whose entry has been randomly drawn and is declared winner refuse to accept the prize as it has been described in these Contest Rules, Contest Organizers will be discharged of any obligation related to the prize with regards to this individual.
- Limitation of Liability – Use of Prize. The prize winner releases Jupa Sports, division of Les Boxers Boyz inc., the participating merchants, their affiliate companies, advertising and marketing agencies, employees, agents and representatives from any responsibility over damages which may result from the redemption or use of their prizes. The prize winner must sign a declaration and release form to this effect before becoming official winner and redeeming his/her prize.
- Limitation of Liability – Functioning of Contest. Jupa Sports, division of les Boxers Boyz inc., their affiliate companies, participating merchants, advertising and marketing agencies, employees, agents and representatives shall hold no liability with relation to improper functioning of any computer equipment, software or online communication that may be related to any faulty, incomplete, or incomprehensible transmission, or any deletion of information by any computer or network, and which could limit or prevent an individual from participating in the contest. Jupa Sports, division of les Boxers Boyz inc, their affiliate companies, participating merchants, advertising and marketing agencies, employees, agents and representatives shall hold no liability for any damage or loss which may result, directly or indirectly, partially or entirely, by the downloading process of any software or any form, and by the transmission of any information related to contest participation.
- Modification. Contest Organizers reserve the right to cancel, terminate, modify or suspend this contest, at their entire discretion, in its entirety or in part if an event, error or any human intervention should occur which would adversely affect the administration, safety, impartiality or progress of the contest as it has been described in these Contest Rules, and do so subject to approval by the Régie des alcools, des courses et des jeux du Québec if required. In no event shall any Jupa Sports, division of les Boxers Boyz inc, participating merchants, their affiliate companies, advertising and marketing agencies, product or service suppliers for this contest, as well as their employees, agents and representatives be obliged to award any more awards than allowed for in these Contest Rules, or to award prizes in a way that is not compliant with these Contest Rules.
- Impossibility to Act – Work Conflict. Jupa Sports, division of les Boxers Boyz inc, their affiliates, advertising and marketing agencies, employees, agents and representatives shall bear no responsibility at all under any circumstance in which their impossibility to act should result from an event or situation beyond their control, or from a strike, lock-out or any other work conflict at their organization, or from any organization or company whose services are used for the purposes of this contest.
- Limitation of Liability – Participation. By participating or trying to participate in this contest, all individuals release Contest Organizers, the participating retailers, their affiliate companies, advertising and/or marketing agencies, employees, agents and representatives from any damages which may result from their participation or attempt at participation in this contest.
- Authorization. By participating in this contest, the winning party authorizes Contest Organizers, their partners, representatives and prize suppliers to use their name, photos, images, comments with regards to the prize, place of residence and/or voice commentary, if required, and do so without any form of remuneration, and at the discretion of Contest Organizers, without a time limitation, in any form of media, even on an international scale, for purposes of advertising or for any purpose deemed relevant.
- Communication with Participants. There will be no communication (other than at entry time), or correspondence between participants and Contest Organizers for purposes of this contest, other than with the individual whose entry form is declared a winner.
- Decisions of Contest Organizers. All decisions made by Contest Organizers or their representatives, as related to this contest, shall be final and not subject to appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec in relation to any issue that may be relevant to the latter’s jurisdiction.
- Litigation. Any litigation with regards to the organization or conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation with regards to the awarding of the prize may be submitted to the Régie only for the purposes of a legal intervention and the possibility of a ruling.
- Identification of Participant. For the purposes of these Contest Rules, the participant is the individual whose personal information details are provided during the telephone contact. This is the individual who will be asked a math skill-testing question and who will receive the prize if he/she is declared a winner.
